Personality Pop-Up™ Terms of Service

1. Services Provided
Personality Pop-Up™ provides photography sessions and related services for families and children through scheduled events and online booking.
2. Booking & Payments
Sessions must be booked in advance through our website. Full payment or a deposit may be required at the time of booking (as stated on the booking page). Deposits reserve your time slot and fees are non-refundable unless otherwise noted in your session agreement.
3. Cancellations & Rescheduling
Cancellation and rescheduling policies are stated on the booking page and in your confirmation emails. If you are unable to attend your session, please contact us promptly at hello@personalitypopup.com.
4. Use of Images
By participating in a session, you grant Personality Pop-Up™ the right to photograph your child(ren) and deliver images for your personal use. With your consent, images may be used for promotional purposes, including our website, social media, or marketing materials. You may opt out of promotional use by contacting us in writing.
5. Intellectual Property
All images, website content, and branding elements are the property of Personality Pop-Up™ / Creative Volition, Inc. and may not be reproduced or used without permission.
6. Communications & SMS Program Terms
By providing your contact information (via booking forms, website forms, or online advertisements), you agree to receive transactional communications, and — where you have separately opted in — marketing communications via email, SMS, or phone from Personality Pop-Up™, a service of Creative Volition, Inc. You may opt out of marketing messages at any time.
SMS program: By checking the SMS consent box on our waitlist or booking forms, you consent to receive recurring automated marketing and informational text messages (such as new session date announcements and open-spot alerts for your selected city) from Personality Pop-Up / Creative Volition, Inc. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time; reply HELP for help or contact hello@personalitypopup.com. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information — your mobile opt-in data is never shared or sold.
7. Limitation of Liability
To the maximum extent permitted by law, Personality Pop-Up™ / Creative Volition, Inc. is not liable for any damages, losses, or injuries resulting from your use of our website, services, or attendance at sessions, and our total liability for any claim related to the services is limited to the amount you paid for the session at issue.
8. Governing Law
These Terms are governed by the laws of the State of Florida (Miami-Dade County jurisdiction).
9. Changes to Terms
We may update these Terms from time to time; the current version is always posted on this page with its "last updated" date. Material changes to the SMS program will be communicated as required by carriers.
